1.GENERAL TERMS AND CONDITIONS OF SALE

The offer and sale of the products under the trademark Roma1947 (“the Products”) through the website www.roma1947.it (“the Website”) shall be governed by these General Terms and Conditions of Sale.

Before sending the purchase order read carefully these General Terms and Conditions of Sale. You may print a copy of the General Terms and Conditions of Sale.

 

A. INFORMATION ON THE SELLER

The jewels sold on the Website are manufactured by Better Silver S.p.A. and sold by Easy Silver srl (“Easy Silver”) with registered office at Via Brescia n. 33, 36040 Torri di Quartesolo (VI), Italy, Italian company registered at Vicenza Company Register (REA) n. 320226 – fiscal code and VAT code 03375690249. Company capital Euro 50.000 f.p.. License to sell precious goods issued by the Questura di Vicenza.

B. FORMATION OF THE SALE CONTRACT

In order to purchase the Products through the Website you may:

If you want to submit an order for the purchase of one or more Products you shall authenticate yourself to access the Website by using the authentication credentials we sent you after your registration to the Website (if you are a registered user), fill out the purchase order and send it through the Website to EASY SILVER, following the instructions. You may access the Website also through Facebook and Google+.

Before transmitting the purchase order form you will be able to check it and correct any mistake using the shopping bag, flag the selected Products and click update shopping cart. By sending the purchase order you expressly accept and confirm these General Terms and Conditions of Sale.

The languages available for the conclusion of a contract with EASY SILVER are Italian and English.

The purchase order will include a summary of these General Terms and Conditions of Sale, information concerning the Products and the related price, the payment terms, the delivery terms and costs.

The contract shall be deemed to enter into force once you will received EASY SILVER’s order confirmation, either by email and through the Website.

In case the purchaser order data are not complete you won’t be able to send the order.

In the event that Products are no longer available, EASY SILVER will promptly inform you by email that the contract is not concluded, explaining the reasons thereto. In case you have already paid the price of the Products, EASY SILVER will reimburse the relevant amount.

The purchase order will be stored on our data base during the execution of the order and in any case for the term provided for by the applicable law in order to comply with the contractual obligations. You may check the purchase orders submitted at any time by using your Account.

 

C. PRICE AND PAYMENT TERMS

The price of each Product (VAT included) is specified in the related product sheet and does not include the delivery costs which will be listed in details in the purchase order before its submission.

You may pay the consideration due by using one of the following payment methods:

Credit card
with this form of payment, at the conclusion of an online transaction, all financial information (credit card number, expiry date, etc.) are automatically forwarded via secure transfer protocol to our bank, which will debit the payment on your bank account. During the processing of the order your credit card number will be forwarded via secure transfer protocol by the service manager listed below and it will not be communicated to EASY SILVER. The information related to your credit card will only be used by EASY SILVER for the execution of the order and in case of prevention or report of a fraud to the Website. The debit of the sums due is carried out only when the Products ordered are shipped. EASY SILVER uses the “Banca Intesa” credit card payment system, which accepts Visa and Mastercard. Secure code: To make online credit card transactions more secure, it is mandatory as of 1st October 2001 to enter a security code (CVC2/CVV2). This information is neither held within the magnetic strip nor printed on the payment receipt. Requesting this code ensures that the client is physically in possession of the original credit card and that the relevant information are not counterfeited. On VISA and Mastercard credit cards, the security code is three digits long and can be found in the top right corner of the space reserved for a signature on the back of the credit card.

 

Payment by bank wire transfer
in case of advanced payment by bank wire transfer the Products ordered will be kept in stock until the related amount is credited on EASY SILVER bank account, which in any case shall occur within 7 days as of the date on which the order was accepted.

In case the sums due are not credited within 7 days as of the date on which the order was accepted, the order shall be deemed null and void.

Payment with PAYPAL
to use this payment method, the client with a PayPal account needs only to select the PayPal option on the checkout page Once you click on conclude order on the order confirmation page you will be forwarded to PayPal login page. The order can then be concluded directly from your PayPal account. The amount due will be debited from your PayPal account without additional fees and on the currency of the account. If you do not yet have a PayPal account, you will have the opportunity to create one during the PayPal payment process.

Products are EASY SILVER’s property until paid in full.

 

D. DELIVERY OF THE PRODUCTS

The Products you purchase will be delivered only from Monday to Friday from 8.30 am to 10.00 pm.

Delivery term:

  • Delivery in Italy: within 3 working days as of the date of the order confirmation and the date of payment. EASY SILVER reserves the right to communicate a different term for deliveries during holidays;
  • Delivery abroad: within 5 working days as of the date of the order confirmation and the date of payment. EASY SILVER reserves the right to communicate a different term for deliveries during holidays.

EASY SILVER shall not be held liable for any late delivery due to the forwarding agent and/or to force majeure.

 

E. DELIVERY COSTS

For purchases with delivery on the Italian territory, shipping is free for orders over €75,00 (including VAT). For amounts of less than €75,00 (including VAT) shipping costs €5.00 (including VAT). Shipping takes place with DHL courier. For shipments to non-EU countries: USA, CANADA, UK, AUSTRALIA the shipping costs are equal to 15 €. No shipments can be made to countries other than those indicated above.

For deliveries in Austria, Belgium, Bulgaria, Ciprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Lithuania, Latvia, Luxemburg, Malta, Monaco, The Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden the delivery costs amounts to Euro 7 (VAT included). For shipments to non-EU countries: USA, CANADA, UK, AUSTRALIA the shipping costs are equal to 15 €. We will not delivery the Products in any other foreign country other than the ones listed above.

 

F. CHECKING OF THE PRODUCTS

Upon receipt of the Products it is your responsibility to check that the package is intact, free from damage and not wet and in any case that the seal has not been tampered with. You shall immediately inform the courier of any damage.

Once the courier’s documents have been signed, you will no longer be entitled to claim anything about the external characteristics of the Product.

Should the delivered Products not correspond with the Products ordered, you shall immediately notify EASY SILVER by email support@roma1947.it or fax to +39 (0444) 467750.

 

G. WARRANTY FOR DEFECTS

The main characteristics of the Products are listed in the relevant products sheet.

The images and colors of the Products in the Website may differ from the actual Products due to the technical characteristics of the browser and the monitor displays. Please keep the purchase invoice / receipt and also deliver it to any recipient of the gift because it serves as original proof of purchase. Without an invoice or receipt, the guarantee is not valid

EASY SILVER guarantees that the Products are free form defects in materials and workmanship for a period of 2 years as of the date of delivery (“Warranty Period”). Should the complaints raised by you during the Warranty Period be grounded and accepted by EASY SILVER, the latter shall remove the defect or replace the defective Product, which will be delivered, at EASY SILVER’s costs, at the same place indicated on the purchase order. Any expenses and charges of Customs during the delivery of the repaired and / or replaced product are charged to the customer.

Subject to the loss of warranty, you shall notify in writing and/or by email to support@roma1947.it any vices and/or defects found within and not later than 2 months as of the date of the relevant discovery.

The warranty is expressly excluded for vices and/or defects of the Products arising from or consisting in:

  • any repair, alteration and/or modification not authorized in writing by EASY SILVER;
  • normal wear and tear of the materials;
  • improper use of the Products.
  • alteration of the surface color

 

The warranty does not provide for the replacement of lost or stolen items.

H. RIGHT OF WITHDRAWAL

Fa piena prova della ricezione la data riportata sulla bolla di consegna.According to articles 52 and following of the Consumer Code (Decree 206/2005 and further amendments) you have the right to withdraw from the contract without cause, by using the form included on each Products sheet, fling and sending it by email to support@roma1947.it within 14 days as of the date of delivery of the Product or, in case of multiple Products ordered in one single purchase order and delivered separately as of the date of the last delivery. The date of delivery shall be the one indicated on the delivery document.

All Products for which you the right of withdrawal shall be sent to EASY SILVER in one single delivery, within 14 days as of the date on which you send the notice of withdrawal, to the following address: Easy Silver S.r.l., Via 1 Maggio n.5, 36050 Bressanvido (VI), Italy, Italia,Ph. +39 0444 660829 Fax +39 0444 460006.

The delivery costs and risks shall be borne by you. You shall send a copy of the notice of withdrawal together with the Product.

Products shall be delivered back to EASY SILVER with the relevant package and label. In case of Products damaged and/or used your withdrawal will not be accepted. Upon receipt of the Products, EASY SILVER will inspect the Products and, in case they comply with this clause, EASY SILVER will send you a notice for acceptance of your withdrawal and inform you about the reimbursement of the price paid, which will be done in the following 5 working days with the same method used for payment.

(excluding any initial delivery costs)

In case the consignee and the person who paid the Products are not the same person, EASY SILVER will reimburse the price of the Products as per this clause to the person who made the payment and into with the same method used for payment.

 

I. COMPETENT COURT – APPLICABLE LAW

All disputes arising out of or relating to the sale and supply of the Products through the Website shall be exclusively submitted to and settled by the Court of Vicenza, Italy.

The Italian law shall be the applicable law.

K. LIMITATION OF LIABILITY

EASY SILVER shall not be liable in case you are not able to access the Website or send the purchase order for the following reasons: force majeure, break-down or malfunctioning of EASY SILVER’s hardware, malfunctioning of the internet services.
